Man accused of filming woman in bathroom at Fishers Kroger

FISHERS, Ind. -- Hamilton County prosecutors filed criminal charges Thursday against a man accused of recording a woman inside a Kroger restroom.

Matthew Martin, 31, faces one felony count of voyeurism stemming from a May 25 incident at the Kroger store at 116th Street and Cumberland Road.

According to a probable cause affidavit filed Thursday, a woman told police she was using the restroom when she observed a cellphone filming her from underneath the stall.

The woman said she yelled, “Oh hell no!” and then ran outside to get her husband.

The suspect, later identified as Martin, then ran out of the bathroom, at which point the woman said she grabbed his shirt collar in an attempt to stop him from running.

Several other bystanders, including a Carmel firefighter and the woman’s husband, also attempted to stop the suspect, but he was able to flee the store.

Police later located him and placed him under arrest based on the description the victim and witnesses were able to provide.

Kroger released the following statement about the incident to RTV6 Thursday afternoon:

“Naturally, we are troubled by this allegation against a customer. Safety and security are always a priority for everyone in our stores.  We are cooperating fully with police as they conduct their investigation.”

In addition to the voyeurism charge, Martin also faces one count of possession of marijuana.

Court records show Martin was released on pretrial supervision on Thursday.
