Noblesville sheriff says employee listened to part of private conversation between teen shooting sus

NOBLESVILLE, Ind. -- Hamilton County Sheriff says an employee listened to part of a confidential conversation between the teen accused a shooting at Noblesville West Middle School and his attorney. 

The teen is accused of opening fire in a classroom on May 25 and injuring a classmate, Ella Whistler, and their science teacher, Jason Seaman. 

The teen was meeting with his attorney on May 26 at the Hamilton County Juvenile Services Center Secure Detention facility when the incident occurred.

The teen's attorney at Eskew Law Firm says it was his first meeting with the suspect. 

Sheriff Mark Bowen said the correction officer who was working the facility's control room was trying to activate a camera in the visitation room and could not get it to work on it its own, so she activated the intercom to get the camera running. 

Sheriff Bowen says once the officer realized the conversation was audible she turned the volume down as low as it could go so the conversation could not be overheard further. 

Staff members immediately reported the incident to Hamilton County Prosecutor D. Lee Buckingham's office. 

The teen's attorney tells RTV6 that Prosecutor Buckingham immediately called his office and made them aware of what had happened. 

Sheriff Bowen says an Internal Affairs investigation was completed and the officer involved received a three-day suspension and retraining in her job responsibilities and in confidentiality visits. 

The intercom system was also repaired immediately following the incident. 

Eskew Law Firm says they do not believe the incident will be detrimental to their case or their client in any way. 

The teen's next hearing is scheduled for two days beginning September 10.
